In pursuance of the Guidelines issued by the Government of India, the State Government of west bengal issues the Guidelines for regulating the business of Direct Selling & Multi-Level Marketing (MLM) and strengthen the existing regulatory mechanism on Direct Selling & Multi-Level Marketing (MLM), for preventing and protecting the legitimate rights and interest of consumer.

These guidelines are called as “West Bengal Direct Selling Guidelines 2018” issued vide No.2287-CA/ESTT/O/1B-34/16 by notification dated 6th July, 2018 and published in The Kolkata Gazette.

To conduct direct selling business, every direct selling entity shall maintain proper and updated website with all relevant information of the entity and website should have space for registering consumer complaints and should ensure that grievances are addressed within 45 (forty five) days of making such a complaint. It shall update all desired details of the entity as well as direct sellers on the Direct Selling Portal as designed by the Consumer Affairs Department for the purpose.

The Nodal Department to deal with the issues related to Direct Selling in the state of West Bengal will be Secretary / Principal Secretary / ACS of the Department of Consumer Affairs. The Nodal Officer for issues relating to Direct Selling in the department would be any Joint Secretary / Sp Secretary / Additional Secretary of the Consumer Affairs Department.

Direct selling entities shall provide details of its incorporation and other business details as may be notified from time to time. Such undertakings need to be submitted to the Department annually.
